Data protection, data processing and privacy policy

In order to use some of the features offered on the portal ( www.eobv.at and www.eobv.eu ) (e.g. downloads, certifications), it is necessary for a user to register on the portal. The data disclosed in this way will be treated as strictly confidential in accordance with the provisions of the Data Protection Act in its currently valid version. By entering the user name and password, the user (revocably) agrees that the data will be used by the EOBV office to process inquiries, orders and data collection.

The user has the right to access and correct their registration data on the portal. The user must keep his access code and, if applicable, his password secret and store them carefully; he is liable for misuse arising from careless handling. The EOBV will never request the transmission of passwords in any form. If you are asked for passwords, please contact the EOBV office immediately.

The EOBV also does everything reasonable to protect privacy by using all its economically reasonable technical options (firewall, virus protection, establishment of secure connections) for data protection. Only selected persons who have been specifically sworn to secrecy have access to this data.

If the user wishes, all their data will be deleted from the portal; for this it is necessary to send an email to lg-a@eobv.eu. The office of the EOBV will then confirm your deregistration to the e-mail address to be deleted.

The mail traffic that is conducted with the EOBV is neither monitored nor released; however, the EOBV will inform the public prosecutor’s office immediately if it is a matter of threats against persons, violations of personal rights or violations of the law that require criminal prosecution. The user agrees to respect the relevant national and international laws.

An example of identity deception can be the imitation of another natural or legal person. If a user complains that someone is appearing under their name, this will be reported without exception and followed up by the responsible authorities.

All rights and obligations arising from the use of the EOBV portal are subject to Austrian law. The place of jurisdiction is the court responsible for the respective location of the office. For legal disputes with consumers within the meaning of the Consumer Protection Act, the places of jurisdiction specified there apply.

User Risk of Use

The user is aware that downloading data is done at his own free discretion and risk; he is responsible for any damage to his computer system, even if this leads to data loss. The EOBV and its members (diving instructors) endeavor to use state-of-the-art and economically viable security technologies, but cannot guarantee that under no circumstances will virus-contaminated e-mails be sent or attacks by hackers made possible by basic product errors will be carried out via this website. The EOBV assures the user that if he becomes aware of a threat, he will immediately inform the user and shut down the service.

The management of the office reports any weaknesses and violations in the area of data privacy to the Executive Committee and, if necessary, to the authorities.

The Austrian Data Protection Act (DSG) gives you the following rights with regard to your data in relation to any company (association):

Information about data used § 26 DSG stipulates that every person can request information about the data processed about this person after appropriate proof of their identity. Such information must be provided within 8 weeks of receipt. If no data on a person is processed, this must also be communicated by the company (association).

Correction and deletion of data § 27 DSG gives every person the right to correction or deletion of their data. This means that incorrect data or data processed contrary to the provisions of the Data Protection Act must be corrected or deleted. Furthermore, people can revoke their consent to the use of their data at any time.

Note: According to FK-V, BGBL 13/2007, the EOBV is obliged to keep all training data of diving students and diving instructors for 40 years!
